All cakes made by CAKELIN LTD are subject to the following terms and conditions.

Cakelin is a private limited company. We are registered in England and Wales with our registered office address at CAKELIN LTD, 24 Queenswood Drive, Leeds, LS6 3LG. Company registration 14704498.

All cakes made by (Cakelin) "seller / we/ us / our” and all orders made by the (customer) “buyer / you”, are subject to these terms and conditions unless varied in writing and signed by both parties. Once an order has been placed, your order is considered firm and there will be a contract between us. The contract will end upon satisfactory receipt of cakes.

All cakes, fillings and icings may contain nuts, dairy, eggs, wheat, soya, gluten, lupin, sesame or other allergens. It is the responsibility of the customer to inform us prior to the confirmation of their booking of any allergy issues. It is the responsibility of the customer to inform their guests of all allergy information and therefore Cakelin will not be held liable for any allergic reaction resulting from consumption of the cake. All products are made to be eaten on the day of the celebration.

We will use our best endeavours to produce a cake that matches the design agreed with you. The parties agree that Cakelin “we” have the right to use artistic licence to change the design of the cake as needed in the event the design does not flow when decorating the cake. Where a sample of coloured fabric or ribbon has been provided to us by you for colour matching purposes, we will do our best to match the colour as closely as possible, but we accept no liability if it is not an exact match.

We ask for minimum of 1 week notice on our cake slices orders, 3 weeks' notice on our celebration cake orders and 6 weeks' notice on our wedding cake orders. Some simple design cakes can sometimes be made with less notice depending on the number of orders in that week. Orders can be made over the phone, through the website chat, by email or in person.

Any products ordered from a picture or photo of a product produced by any other cake maker, can only be reproduced by us as our interpretation of that product and will NOT be an exact reproduction of the product in the picture or photo.

At the time of ordering your cake, a deposit of 50% of the cake cost is required to secure the event date for the cake. The payment can be made via bank transfer or cash. The final payment for cake slices is due 1 week before your chosen date, and for celebration cakes is due 2 weeks before the celebration date, while the final payment for wedding cakes is due 4 weeks before the wedding date.

We charge £25 for a consultation which is refundable against the deposit if you wish to go ahead and book your cake with us.

Our cakes are available for both delivery and collection. Delivery fee is payable and is included in the invoice. Delivery/collection date and time will be arranged and agreed by both parties.

At the time of collection/delivery, a release form to be signed by the person collecting /receiving the cake, stating the cake collected/received and in a perfect condition.

When collection a cake, it is the responsibility of the customer to check the state of the cake before leaving our premises. Once the cake has left our premises, the customer is responsible to ensure that cake gets to its destination safely and is cared and stored as per our instructions to achieve best results for taste and quality.

Delivery will be carried out in a safe and appropriate manner. Once the cake is delivered to the customer and handed over in perfect condition, it is then the customer's responsibility to care and store the cake as per our instructions. If anything is to happens to the cake after that, we are not liable for any damages.

For wedding cakes delivered to venues, we will take photographs of the cake from all angles upon delivery to the venue and after setting up. We are not liable for any loss or damage to the cake once it has been delivered to the venue and, set up.

A delivery date and time will be agreed by both parties, and if the customer is not at location at this time and date, and we are not able to contact the customer, the cake will be transported back with our premises, and it will be the customer's responsibility to collect the cake.

We highly recommend that you receive delivery of your cake yourself, but in the event of you request for your cake to be left in a safe place or with a neighbour, please make this clear at the time of order. We cannot accept responsibility for any damage or losses caused as a result of this.

We will attempt delivery to the address and postcode that has been provided by you; we will not accept responsibility for late or failed delivery due to an incorrect address.

We will aim to deliver the cake on the scheduled delivery date and time. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period, and we will contact you to arrange an alternative time.

Before we hand over or deliver the cake to the customer, we take photographs of the cake from all angles to proof the cake is in a perfect condition.

At the time of collection/delivery, a release form to be signed by the person collecting /receiving the cake, stating the cake collected/received and in a perfect condition.

We do not accept any liability for loss or damage that may occur thereafter.

In the unlikely event that you have a complaint about your cake, please inform Cakelin "us" so that we may have the opportunity to resolve matters immediately. If any problem cannot be resolved at that time, then you should write to us within 14 days to enable us to investigate and report to you. Accordingly, it is a term of our agreement with you that we cannot consider complaints made after 14 days as we are deprived of the opportunity to investigate any facts that you may complain of. If we cannot resolve your complaint following your writing to us, you will agree to meet with us to try to resolve matters. If this meeting fails to resolve any dispute, any legal claim you bring will be limited in value to the total cost of the cake and in respect of which any complaint is made.

Where we cancel the booking due to illness or any other unforeseen circumstance that affects the ability to deliver the ordered cake, the deposit will be refunded within seven (7) days of notification to the Customer.

If, for any reason the event is required to be postponed, please contact me immediately. The new date proposed will be subject to availability.

If you wish to make alterations to the cake as detailed on the invoice accompanying these terms and conditions, you must contact us immediately. We will assess your request for an alteration and will notify you to confirm its effect (if any) on the price quotation and the agreed timetable prior to the event. Accepting a request for the alteration of a cake order is at our discretion. We offer a customised services and we are limited to the number of orders we accept.

You may cancel a celebration or wedding cake order at any time provided that the cancellation is made by the person who placed the order, or another person authorised to act on their behalf, and is communicated to us in writing. Since such cancellation results administrative costs, lost business and affects our commitment to other customers, we will apply cancellation charges as follows:

Refunds will be paid within 14 days of cancellation.

We reserve the right to use any image or photograph of a cake made by us for use in its publicity and promotional material, including publication in wedding magazines at a later date.

You acknowledge that any review, feedback or rating which you leave may be published by us on the website and you agree that it may be displayed for as long as we consider appropriate and that the content may be syndicated to our other websites, publications or marketing materials.

You will grant us a licence to use, store, copy, make available to third parties, distribute and publish the content of any review submitted by you.

You undertake that any review, feedback or rating that you write shall:

• Comply with applicable law in the UK and the law in any country from which they are posted.
• Be factually accurate.
• Contain genuinely held opinions (where applicable)
• Not contain any material which is either defamatory, threatening, obscene, abusive, offensive, hateful, inflammatory or is likely to harass, upset, annoy, alarm, embarrass or invade the privacy of, any person or be deceiving.
• Not promote or advocate an unlawful act or activity, discrimination, sexually explicit material or violence
• Not infringe any trademark, copyright (including design rights), database right, or other intellectual property rights of any other person or breach any legal duty you owe to a third party.
• Not be used to impersonate any person, or to misrepresent your identity.

We are not responsible to any third party for the content or the accuracy of the content which you have posted or uploaded.

You agree to indemnify and hold us harmless against any claim or action brought by third parties, arising out of or in connection with any review, feedback or rating posted by you on the Website, including, without limitation, the violation of their privacy, defamatory statements or infringement of intellectual property rights.

You grant us and our affiliate companies a non-exclusive, royalty-free worldwide license to use or edit any reviews posted by you.

We reserve the right to publish, edit or remove any reviews without notifying you.

You agree that we may disclose your identity to any third party who claims that content which you have posted or uploaded infringes their intellectual property rights or right to privacy or is defamatory.

The views expressed by other users on the Website do not represent our views or values.

We shall have no liability for delays or failures in delivery or performance of our obligations to you resulting from any act, events, omissions, failures or accidents that are outside of our control ('Force Majeure'), which, without limitation, include:

• Shortages of labour, fuel, power, raw materials.
• Late, defective performance or non-performance by suppliers.
• Private or public telecommunication, computer network failures or breakdown of equipment.

• Fire, explosion, snow, storm, flood, earthquake, subsidence, epidemic or other natural disaster or extreme weather conditions.

• Acts, decrees, legislation, regulations or restrictions of any government, and other causes, beyond our reasonable control.

Our performance will be deemed to be suspended for the period that the event of Force Majeure continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to minimise any delay caused by Force Majeure or to find a solution by which our obligations may be performed despite the Force Majeure event. We shall promptly notify you of any Force Majeure event giving details of it and (where possible) the extent and likely duration of any delay. Where the period of non-performance or delay in relation to any event of Force Majeure exceeds 30 days from the date of notice to you of the event of Force Majeure, either you or we may, by written notice to the other, terminate the Contract with immediate effect.

These terms and conditions are governed by English Law and the exclusive jurisdiction of the English courts.
